The Thurgood Marshall College Fund (TMCF) Government Affairs team is pleased to announce that the US Senate passed S. 23 on Tuesday, 8 March 2011 and the US House passed H.R. 1249 on Thursday, 23 June 2011. Both the US Senate and US House will need to pass a final bill that both chambers agree on the language.
The conference bill will have an impact on all of our HBCUs/PBIs based upon the following language: “An analysis of the effect of prior user rights, if any, on small businesses, universities, and individual inventors.”
The bill will allow the following: “Permits a civil action by a patent owner against another patent owner claiming to have the same invention and who has an earlier effective filing date if the invention claimed by the earlier patent owner was derived from the inventor claimed in the patent owned by the person seeking relief. Requires such an action to be filed before the end of a specified one-year period.
Expresses the sense of Congress that converting from a ‘first inventor to use’ to a ‘first inventor to file’ patent registration system will: (1) provide inventors with greater certainty regarding the scope of protection, and (2) promote international uniformity by harmonizing the U.S. patent registration system with systems commonly used in other countries with whom the United States conducts trade.”
“This legislation will benefit universities and strengthen the U.S. patent system overall, enhancing the capacity of the system to promote invention, innovation, and U.S. economic competitiveness in the increasingly competitive global environment of the 21st century.” This statement is from the following organizations: Association of American Universities (AAU), American Council on Education (ACE), Association of American Medical Colleges (AAMC), Association of Public and Land-grant Universities (APLU), Association of University Technology Managers (AUTM), and the Council on Government Relations (COGR). These organizations go on to state that “among the key features of H.R. 1249 that will strengthen the U.S. patent system are: Adopting a First-Inventor-to-File System, Improving Patent Quality, Reducing Patent Litigation Costs, and Providing the U.S. Patent and Trademark Office with Critically Needed Resources.”
